1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

2.3 We reserve the right to refuse to collect any waste that we reasonably believe to be hazardous, prohibited, incorrectly described, not safely accessible, or in breach of relevant waste regulations.

2.4 Services are subject to vehicle access, safe working conditions, and compliance with all applicable laws and regulations.

3. Booking Process

3.1 Bookings may be made by telephone, email, online form or other methods we make available from time to time.

3.2 When placing a booking, you must provide accurate and complete information, including:

(a) your name and contact details; (b) the collection address and any access restrictions; (c) the type of waste; (d) the estimated volume or weight of waste; (e) preferred date and time window for collection; and (f) any special handling requirements.

3.3 We will provide you with a quotation based on the information you supply. Quotations may be given as a fixed price, a price range, or a price based on load volume, weight, or time on site.

3.4 A booking is only confirmed when we have accepted your request and you have accepted our quotation. We may confirm this verbally or in writing, including by email or text message.

3.5 The quoted price is based on the accuracy of the information you provide. If on arrival we find that the waste type, volume, access conditions or other key details differ significantly from what was described, we reserve the right to amend the price or decline to carry out the service.

4. Access and Customer Responsibilities

4.1 You must ensure that our team has safe, reasonable and legal access to the Site and to the waste to be collected at the agreed time.

4.2 You are responsible for securing any necessary permissions, permits or authorisations required for access to private land, communal areas or restricted zones.

4.3 You must ensure that the waste to be removed is clearly identified and separated, where necessary, from items not intended for collection.

4.4 Where parking is required, you are responsible for arranging suitable parking or permits. Any fines or penalties incurred due to inadequate parking arrangements may be charged to you.

4.5 If we are unable to access the Site or the waste due to circumstances within your control, we may charge a call-out fee or a failed collection charge to cover our time and costs.

5. Pricing and Payments

5.1 All prices are quoted in pounds sterling unless otherwise stated and may be subject to VAT where applicable.

5.2 Our charges may be based on factors such as volume of waste, weight, type of waste, loading time, access conditions and disposal costs.

5.3 Unless otherwise agreed in writing, payment is due immediately upon completion of the service. We may accept payment by cash, card, bank transfer or other methods notified to you.

5.4 For business customers, we may agree credit terms at our discretion. Where credit terms are agreed, invoices must be paid within the period stated on the invoice.

5.5 If payment is not received when due, we reserve the right to charge interest on the overdue amount at the statutory rate, and to recover all reasonable costs and expenses incurred in pursuing late payment.

5.6 We may require a deposit or full payment in advance for certain bookings, including high-value collections or services outside standard hours.

6. Cancellations and Amendments

6.1 You may cancel or amend a booking by contacting us using the contact details provided at the time of booking.

6.2 If you cancel more than 24 hours before the scheduled collection time, no cancellation fee will usually apply, unless we have incurred non-recoverable costs directly relating to your booking.

6.3 If you cancel less than 24 hours before the scheduled collection time, we may charge a cancellation fee to cover the costs of allocated staff, vehicles and administration.

6.4 If we arrive at the Site at the agreed time and are unable to carry out the service due to reasons within your control, including lack of access, incorrect address, waste not ready, or unreasonable delays, we may charge a failed collection fee.

6.5 We reserve the right to reschedule or cancel a booking where necessary due to vehicle breakdown, staff illness, severe weather, safety concerns, or other circumstances beyond our reasonable control. In such cases, we will endeavour to notify you as soon as reasonably practicable and offer an alternative appointment. We will not be liable for any indirect loss arising from such rescheduling or cancellation.

7. Waste Types and Regulations

7.1 We operate in accordance with applicable UK waste management legislation and regulations. We are committed to lawful and responsible waste collection, transport, recycling and disposal.

7.2 You are responsible for accurately describing the waste to be collected. You must inform us in advance of any items that may be hazardous, restricted or require special handling, such as chemicals, oils, asbestos, clinical waste, gas bottles, batteries, or electrical equipment subject to specific regulations.

7.3 We do not collect certain hazardous or prohibited items. If such items are found amongst the waste on arrival, we may refuse to take them, adjust the price to reflect specialist handling costs, or decline to perform the service.

7.4 Title to the waste passes to us once it has been loaded onto our vehicle, subject to our right to return any prohibited or misdescribed items to you or to require you to remove them at your own cost.

7.5 We will determine the most appropriate disposal route for the waste, including re-use, recycling, recovery or disposal at authorised facilities. We may separate materials to maximise recycling and lawful disposal.

8. Customer Warranties

8.1 You warrant and represent that:

(a) You are the owner of the waste or have full authority from the owner to arrange its removal;

(b) The waste does not include any items that are illegal to possess, handle, transport or dispose of, and does not breach any applicable regulations;

(c) All information you provide about the waste and the Site is accurate and complete.

8.2 You agree to indemnify us against any loss, damage, penalty or claim arising from a breach of these warranties, including any costs related to the handling of prohibited or misdescribed waste.

9. Liability and Limitations

9.1 We will exercise reasonable care and skill in providing our services. However, our liability to you is subject to the limitations set out in this section.

9.2 We will not be liable for any damage to property or items that occurs due to pre-existing defects, inherent weaknesses, poor condition, inadequate packaging, or where reasonable care has been taken by our team and the damage was not caused by our negligence.

9.3 You are responsible for removing or protecting items that may be vulnerable to accidental damage during the clearance process, such as fragile decorations, pictures, ornaments or loose items in access routes.

9.4 To the fullest extent permitted by law, we will not be liable for any indirect or consequential loss, including loss of profits, business interruption, or loss of opportunity, arising out of or in connection with our services or these Terms and Conditions.

9.5 Our total aggregate liability to you for any loss or damage arising from any single claim or series of related claims shall not exceed the total price paid or payable by you for the specific service giving rise to the claim, except where such limitation is not permitted by law.

9.6 Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter where it would be unlawful to exclude or restrict liability.

10. Delays and Events Beyond Our Control

10.1 We will use reasonable endeavours to carry out collections on the agreed date and within any indicated time window. However, times are estimates only and are not guaranteed.

10.2 We will not be liable for delays, failures or inability to perform our obligations caused by events beyond our reasonable control, including severe weather, traffic disruption, accidents, road closures, industrial action, power failure, or failure of third party systems.

10.3 If performance of our services is materially affected by an event outside our control, we will contact you as soon as reasonably possible to arrange a suitable alternative date or solution.

11. Complaints and Service Issues

11.1 If you are dissatisfied with any aspect of our service, you should notify us as soon as possible, providing details of the issue and any supporting information.

11.2 We will investigate complaints in a fair and timely manner and may ask you for further information or evidence to help us assess the matter.

11.3 Where we determine that we have failed to perform the service with reasonable care and skill, we may, at our discretion, offer to re-perform the service, provide a partial refund, or agree another appropriate remedy, in accordance with your statutory rights.
